《劳动合同法》实施后，“末位淘汰”只能解决劳动者在单位中位置的“上上下下”，但不能解决劳动者的“进进出出”问题。
有些公司采取末位淘汰制，比如，某员工如果连续三个月都排倒数5名，就要被“炒鱿鱼”；在《劳动合同法》出台后，末位淘汰制就是违法行为。
又到了年终考核阶段，AD公司最近进行了一次绩效考核，但是绩效考核的结果并不能让人力资源总监Walter满意，员工的工作态度、工作能力都呈现集中分布，拉不开差距。
比如：从技术部的考核结果看，有两个员工的分数一样，其他的相差不大，基本都只差0.5分，部门没有一个员工的绩效结果不好，至少都在85分以上，最高的居然达到96分，可以说各个都是“优秀员工”了。如果以这个考核结果发奖金，就会吃“大锅饭”了。
于是，Walter希望通过强制分布拉开差距。按照正态分布打分，拉开了差距，但是也产生了一些问题。比如技术部经理反映：“我们部门的员工每个人表现都非常好，硬要把他们评出个优良中差，会挫伤他们的积极性。”品牌部是刚成立的部门，经理说：“我们部门下半年才成立，只有3个员工，怎么正态分布呀？”
人力资源专家建议，在大多数情况下，使用正态分布是有利于激励员工的，比如，杰克·韦尔奇就在其自传中提出过“活力曲线”理论。但是，只有两三个人的部门可以不使用正态分布；部门多于三人的按人力资源部门规定的比例进行分布，具体由各部门主管决定，经主管认可后提交人力资源部。
考核最好在部门层级上体现出优良中差，相应地，年终奖也可以分为部门奖金和个人奖金两部分，这对各个部门和各个团队是个有效的鞭策。
绩效考核不要变“穿小鞋”
在对绩效做正态分布的同时要掌握好绩效面谈，使用不当则可能激化矛盾。主管要意识到考核不是一个淘汰或惩罚的工具，而是一种提升和促进员工成长的手段，不可以在考核中给员工“穿小鞋”。主管要让员工意识到强制使用正态分布，只是一种考核结果的排列方式，目的是通过分布让员工看到部门与自己的不足，便于自己的调整，以及来年人力资源部进行有针对性的人力资源规划和培训。
“末位淘汰”只能调岗位
在使用强制正态分布时，以前有些公司采取末位淘汰制，比如，某公司员工如果连续三个月都排倒数5名，就要被“炒鱿鱼”；不过在《劳动合同法》出台后，末位淘汰制就是违法行为。
专家解释，考核不合格与不胜任工作是两回事。在某企业考核中占据末位的员工在全社会来看，绩效也未必不高，工作能力也未必不能胜任工作。用人单位凭借末位考核单方面解除劳动合同关系是不合法的。现在《劳动合同法》中已删去了“双方当事人可约定劳动合同的终止条件”这一条，用人单位终止劳动合同只能依据《劳动合同法》第四章列举的情形，其中并无“末位淘汰”一项。
末位淘汰只能解决劳动者在单位中位置的“上上下下”，但不能解决劳动者的“进进出出”问题。当然，如果员工完成不了考核，企业将其调换工作岗位，或者进行培训再上岗是可以的。 (作者：吴润洲) |
